  • These self-imposed limits restrict you from playing or depositing more than your set amount for daily, weekly, or monthly periods. They can’t be removed for  90 days.
  • Timeouts disable you from depositing funds or placing entries for a time period of your choice. You will, however, still be able to withdraw funds.
  • This self-imposed feature lasts for 30+ days and blocks you from accessing your account and receiving marketing notifications. Before your self-exclusion goes into effect, you will be able to withdraw your finds.

Remember, these tools are beneficial for all members, and are not designed just for those who suspect they may have a problem.

Chief Executive Officer

Thariq Kara founded Athstat, together with Kisset Chirengende in 2019. He is also the CEO of NU Borders LLC, a Washington DC and Boston-based company focused on providing advanced analytics, data science and custom software engineering services to the US Government. Customers include the Department of Defense, Department of Homeland Security, and the Department of State. Prior to founding NU Borders, Thariq was a Government employee at the Department of Homeland Security, Immigration and Customs Enforcement (DHS-ICE) where he ended his career as the Chief Data Architect for the Agency.

Thariq graduated from the Florida Institute of Technology with a BSc in Mechanical Engineering and captained the Men’s Tennis team competing in the NCAA Division II. He then went on to complete a graduate degree in Engineering Management at Duke University.

Kisset Chirengende

Chief Operating Officer

Kisset founded Athstat together with Thariq in March 2019. He also co-founded Kyros Sports in 2011. During his time with Kyros Sports, the organization has put together high-profile fixtures involving Super Rugby franchises, Vodacom Bulls, Toyota Cheetahs, DHL Stormers, Emirates Lions + Kyros Sports owned invitational side, Zambezi Steelers. In 2020 Kyros Sports facilitated arguably Major League Rugby’s biggest signing, when World Cup winner Beast Mtawarira penned a deal with Washington D.C’s expansion team Old Glory D.C. Kisset graduated from Leeds Beckett University in West Yorkshire, England with a

B.A in Sport Business Management.

Apart from running Kyros Sports, he is also the current head coach of William Paterson University rugby program and has helped lead the Pioneers to three consecutive 7s Tri-State Conference Championships, two 15s Tri-State Conference Championships, as well as numerous national title runs as both an assistant coach and head coach.

Dr. Timothy Gildea

Athstat Advisor

Special Agent (Retired) Timothy N. Gildea worked for U.S. Immigration and Customs Enforcement (ICE), Homeland Security Investigations (HSI), and its predecessor agency U.S. Customs Service from 1983 to 2014.

He has conducted numerous cross-border crime investigations and served on several forces including the Joint Terrorism Task Force and the Drug Enforcement Agency’s Transportation Task Force. From 2003 to 2009, Special Agent Gildea served at the Assistant ICE Attaché, Toronto Office. He has also served as a Special Agent and Counter-Proliferation Investigations Program Manager in Boston, MA and Washington, DC, respectively.

For the last five years, Timothy has worked with the Department of Homeland Security, Science and Technology, the Export Enforcement Coordination Center (E2C2) and Northeastern University, in developing the Border Enforcement Analytics Program (BEAP), that established Big Data analytic capabilities and methodologies to search high-volume government and trade data sets for indicators of illicit proliferation and other border-related violations.

Timothy received his Ph.D. in Law and Policy from Northeastern University, Boston, MA in 2003.

User access controls for all sports pool personnel

  1. We will assign different roles and permissions (admin, user) to our staff based on their job functions and responsibilities, such as administrators, users, etc. Each role will have a defined set of access rights and privileges to the sports pool system and the data stored in it, such as creating, modifying, deleting, or viewing records, transactions, reports, etc. The roles and permissions will be documented and approved by the management.
  2. We will ensure that only authorized staff can access the sports pool system and the data stored in it, such as using passwords, tokens, etc. The access credentials will be unique and confidential for each staff member. The access methods will be secure and encrypted to prevent unauthorized access or interception.

Internal Controls for Sports Pool Wagering Operations

Description of Duties:

  1. Mobile Development: Responsible for developing the Android and iOS game applications.
  2. Web Development: Responsible for developing the Web game application.
  3. Customer enquiries/services: Handles customer inquiries and disputes.
  4. Financial Management: Manages financial transactions, including deposits, withdrawals, and financial reporting.
  5. Compliance and Security: Ensures compliance with regulatory requirements and maintains the security of our systems and data.

Segregation Strategy

  1. No single individual has control over all aspects of any financial transaction.
  2. Access controls: Users will only have access to systems and data within their scope of work. For instance, those handling financial transactions will not also have access to modify game data.

  1. We will implement role-based access controls in our systems. Users will be grouped based on their roles, Access control policies will be set adhering to the principle of least privilege. Users will only have access to information required to carry out their responsibilities.

Automated and manual risk management procedures

  1. We will identify and assess the risks associated with our fantasy sports gaming operations, such as financial, legal, technical, or reputational risks. We will use combination of automated and manual controls to manage these risks, depending on their nature and severity. We will document and communicate the risks to the relevant stakeholders.
  2. We will develop and implement risk management policies and procedures that address the identified risks, such as using automated or manual controls, or a combination of both. The policies and procedures will be reviewed and approved by the management and communicated to the staff.

What constitutes fraud/suspicious activity in the game's context –

  1. Sharing of account details with others to gain a competitive advantage.
  2. When players create more than one account and join multiple leagues with the intent of increasing the chances of winning the prizes.

  4. The use of automated tools to pick teams or join multiple leagues.
  5. Attempting withdrawals from another users account.
  6. Multiple withdrawal requests for the same leagues.
  7. Acts in violation of Athstat games terms of service.

Procedures to prevent wagering by patrons prohibited from wagering

We will use Idology to verify users and their identity as follows:

  1. Idology is a global provider for identity verification and document authentication solutions that uses a combination of data sources, machine learning, and human verification to confirm the identity of our users. Idology will help us ensure the accuracy, security, and compliance of our identity verification process.
  2. Idology will allow us to verify the identity and eligibility of our users before allowing them to participate in the sports pool wagering operations, by using age verification, ID checks, self-exclusion lists, etc. Idology will also maintain a record of the verified users and their eligibility status.

Description of anti-money laundering compliance standards

In order to comply with US- based anti money laundering (AML) and counter-terrorism financing rules and regulations (the game will only be offered in the US), our team will perform the following due diligence:

  1. Users will be screened using the Business Intelligence for Trade Enforcement (BITE) platform (https://bitedata.io), to identify individuals who might fall into the following categories:
  2. Sanctioned individuals by US, EU, Canada and Australia Government agencies who are not allowed to do business with US companies
  3. Politically Exposed Individuals (PEPs) who are high risk
  4. Any users identified to be in these categories will be flagged, their identity confirmed, and our team will work with Athstat payment platforms Inovio (credit cards processing) and Seamelss (ACH processing) to ensure the are performing checks on all transactions per US and international AML regulations, including but limited to:
  1. Identifying high risk users
  2. Identifying indicators or risky transactional behavior
  3. The platform itself does not provide high rewards and is very low risk for AML activity - however our team will ensure we provide the utmost due diligence to ensure we are on the right side of compliance

Description of all types of wagers available

Paid Leagues:

  1. Participation in Athstat's paid leagues is facilitated through a paid-entry system. Users are required to acquire an in-game currency, which serves as the entry fee for these leagues. Within the framework of paid leagues, participants have the opportunity to earn monetary rewards based on their performance in the league.

Description of all integrated third-party systems

We will use the following integrated third-party systems for our fantasy sports gaming operations:

  1. Signature: Signature is a payment processing company that offers online and offline transaction solutions. It is the parent company of Inovio and Seamless, two payment services that we will use for our fantasy sports gaming app.
  2. Inovio: Inovio is a payment gateway that integrates with our website platform and allows users to purchase Athcoins, the coins that users can use to enter fantasy leagues. One Athcoin is equivalent to one USD. Inovio also provides features such as risk management and recurring billing.
  3. Seamless: Seamless is a payment service that allows users to withdraw their Athcoins using their mobile phones. It uses QR codes and NFC technology to enable fast and secure transactions. It also provides features such as loyalty programs and analytics.
  4. Idology: Idology is an identity verification and document authentication provider that uses data sources, machine learning, and human verification to confirm the identity of our users. It also helps us monitor and detect fraud, comply with regulations, and perform step-up authentication and reverification.

Procedures for Reconciliation of Assets

Procedures for the reconciliation of assets and documents contained in the wagering cashier drawers and automated ticket machines, which shall provide for the reporting of any overage or shortage;

  1. Our reconciliation procedure will concentrate on the virtual assets, specifically the in- game currency. Frequent audits will be carried out by our compliance officer, comparing the virtual assets logged in the game's database against the real assets stored in the transaction logging system.
  2. Once an inconsistency is discovered, assets in excess or deficit. The reason will be reported and examined by the compliance officer.
  3. Our reporting system will offer comprehensive details about the discrepancy's nature and scale, facilitating quick rectification.

In the event of a failure of the sports pool's ability immediately to pay winning wagers, the licensee shall have internal controls detailing the method of ultimately paying winning wagers. The licensee also shall file an incident report for each system failure and document the date, time and reason for the failure along with the date and time the system is restored with the commission. (b) Reconciliation.

The internal controls shall detail the reconciliation of assets and documents contained in a sports wagering lounge cashier's drawer.

Our internal controls for the event of a failure of the gaming system’s ability to pay winning wagers and the reconciliation of assets and documents are as follows:

  1. In the event of a failure of the sports pool system’s ability to pay winning wagers, we will determine the cause and extent of the failure and notify the affected customers and the commission as soon as possible. We will restore the normal functioning of the sports pool system and verify the accuracy and completeness of the data and transactions. We will document and report the details of the failure and the actions taken to resolve it, such as the date, time, reason, outcome, and impact of the failure.
  2. The internal controls shall detail the reconciliation of assets and documents contained in a sports wagering lounge cashier’s drawer, such as cash, tickets, vouchers, receipts, etc. We will count and verify the assets and documents with the records and reports generated by the sports pool system and identify and resolve any discrepancies. We will secure and store the assets and documents in a safe and tamper-proof location and maintain a record of their movement and custody.

Contests

A highly experienced player, one defined as a player who has previously won a paid league, will have a trophy icon next to their name at all instances across the app. When a user looks into joining a league, they will be able to clearly see all experienced players in said league.

  1. On a contest’s (paid fantasy league) information tab it will disclose the maximum number of total entries allowed for each contest.
  2. On the contest’s (paid fantasy league) information tab, there will be a clickable information icon, this icon will explain that a user can join a contest ONCE with each team. However, a user can create up to 150 teams and can then enter each contest ONCE with each team. Therefore, the total number of entries a single authorized user can have is 150.
  3. If an authorized user tries to enter the same team into the contest (paid fantasy league) they will be unable to join. If an authorized user tries to submit more than 150 teams per contest (paid fantasy league) they will be blocked from doing so.
  4. A user has to enter contest themselves, they will not be auto-entered into any contests. So they may exclude themselves. Per Athstat’s responsible gaming policy, in early 2024 the following feature will be added “ Limits on entries and deposits.
  5. By accessing and using Athstat Gaming Paid Fantasy and entering the Contests, entrants agree to be bound by the decisions of the Contest Entities, which are final and binding in all respects. Athstat reserves the right at its sole discretion to disqualify any individual it finds to be:
  1. Tampering or attempting to tamper with the entry process or the operation of Athstat Gaming Paid Fantasy, any Contest, or any Athstat website
  2. Violating the Official Daily Fantasy Rules, the Official Best Ball Rules, the Official Public Prize League Rules, this Paid Fantasy TOS, or any other guidelines, rules, or instructions associated with Athstat Gaming Paid Fantasy or the Contests
  3. Acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse threaten or harass any other person
  4. Violating the TOS, conditions of use and/or general rules or guidelines of any other services

Self-Imposed

  1. These self-imposed limits restrict you from playing or depositing more than your set amount for daily, weekly, or monthly periods. They can’t be removed for 90 days. Improper Conduct (include, but are not limited to):

Actions deemed as improper conduct include, but are not limited to, those actions outlined in the “Member Conduct” section of the TOS, as well as the following:

  1. False information about your eligibility to enter Contests and collect prizes.
  2. Using any fraudulent, or unauthorized credit cards, or payment methods. Using any automated services or routines including, but not limited to, robots, web crawlers, spiders, ants, and scrapers to access and/or collect information on any Athstat site without explicit written consent from Athstat; this includes uploading, editing or otherwise modifying lineups using any automated scripts or tools or otherwise interacting with Athstat Gaming Paid Fantasy using methods or technology other than the Athstat- provided interface and technology.
  3. Attempting to abuse, as determined solely at Athstat’s discretion, bonuses and promotions.
  4. Attempting to tamper with, or alter a real-life sporting event that is directly connected with the Contests in which you have direct involvement or interest.
  5. Sharing your lineup with other individual(s) prior to a contest starting, including for purposes of engaging in syndicate play or otherwise attempting to collude with other players.
  6. Selling any stakes in your own play, buying stakes in other players, or other means of redistributing entry fees or winnings based on pre- existing agreements or relationships with other players.
  7. Buying or selling lineups to be used on Athstat Gaming Paid Fantasy.
  8. If a user engages in conduct that Athstat determines, in its sole discretion, is harmful or detrimental to other Contest entrants or is unfair, fraudulent or otherwise negatively impacts Athstat Gaming Paid Fantasy we reserve the right to cancel any Contests you created, cancel any of the users Contest entries, refuse to award prizes, limit their participation in Contests, and block their Athstat Fantasy Sports account from any future activity. If an Entrant notices any improper conduct, they can notify our Customer Care team at gaming@athstat.com at once so that we can investigate and take the appropriate action – if any is deemed necessary – against the offending entrants and accounts.

If your Athstat ID is found to be in violation of the terms of service or official rules of another Service, that violation is grounds for Athstat to suspend or terminate your access to all products or Services played under your Athstat ID - including Athstat Gaming

Paid Fantasy. Your Contest entry fee(s) or potential winnings may be forfeited if Athstat cancels any Contests you created, cancels any of your Contest entries, or blocks your Athstat Fantasy Sports account from any future activity as result of your violation of the Agreement.

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR MOBILE APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF Athstat Gaming PAID FANTASY OR THE CONTESTS MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, Athstat RESERVES THE RIGHT TO IMMEDIATELY TERMINATE THE ENTRANT’S ACCOUNT, IF ANY, AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

User information will be stored securely in our database for 5 years. Users can request their information at anytime by emailing gaming@athstat.com Security of all information is of the utmost importance for Athstat. Athstat uses reasonable administrative, technical and physical safeguards to protect the security of your Personal Data from unauthorized disclosure. We also try to ensure that only necessary people and third parties have access to Personal Data. Athstat also reviews its security procedures periodically to consider appropriate new technology and updated methods. We require that our third-party service providers agree to keep all confidential information we share with them and to use the information only to perform their obligations in the agreements we have in place with them.   • In any advertisements about contests, we will provide statistical information for the chances of winning, and we will accurately state the number of winners per each contest

  • A user can create fantasy leagues without an entry free. They will be free from promotion or advertisement of any of Athstat’s online fantasy or simulation sports games or contests with an entry free
  • All advertisements will have disclaimers stating that the advertisement is only intended for those who are authorized to play Athstat Games. User’s who fit our age requirements, and are in a location where our games are permitted.
